Agreement
These terms govern your use of telcoltd.com. By using the site you accept them. If you do not accept them, please do not use the site.
Work we carry out for you is governed by the signed quote, proposal, service agreement or statement of work covering that work. Where those documents and this page disagree, the signed document wins.
Using the site
You may read the site, download material for your own reference, and contact us through it. You may not attempt to gain unauthorised access to it, interfere with its operation, scrape it at a volume that degrades service for others, or use it to send anything unlawful, misleading or abusive.
Quotes, estimates and proposals
Prices, availability and lead times shown on the site or given in an initial response are indicative and are not an offer capable of acceptance. A binding price comes only from a written quote issued by us, and that quote is valid for the period stated on it. Quotes assume the site conditions described to us; work that turns out to need additional cabling, containment, permits, out-of-hours access or remedial work to existing infrastructure will be re-quoted before it is carried out.
Emergency calling
Telephone systems that route calls over the internet do not behave like traditional analogue lines in an emergency. Emergency services may not be reachable during a power cut or loss of internet connectivity, and the location passed to a dispatcher depends on the registered address held for each handset or endpoint. If you move a device to a different building, floor or suite, you must tell us so the registered location can be updated. Keep an alternative means of calling emergency services available, and make sure the people on your site know what it is.
Equipment and third-party products
Hardware and software we supply carry the manufacturer’s own warranty, and the manufacturer’s licence terms apply to their software. We will help you make a warranty claim, but we do not extend or replace the manufacturer’s warranty unless a written maintenance agreement with us says otherwise. Title to equipment passes to you on payment in full; risk passes on delivery to your site.
Our intellectual property
The design, text, photographs, logos and code on this site belong to Telco Communication Systems or to our licensors, and are protected by copyright and trade mark law. You may not copy, republish or adapt them for commercial use without our written permission. Designs, schematics, configuration files and documentation we produce for you are licensed to you for the operation and maintenance of your own system.
Your material
Anything you send us through the site — enquiry details, requirements, site drawings — remains yours. By sending it you give us permission to use it for the purpose of responding to you and carrying out the work. Please do not send confidential material through the website before we have a confidentiality agreement in place.
Availability
We aim to keep the site available, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it without notice. Service levels for systems we support are set out in your maintenance agreement, not here.
Disclaimers
The content of this site is provided for general information. It is not engineering, security, compliance or legal advice, and it should not be relied on as the basis for a design or a purchase without a survey. To the fullest extent permitted by law, the site is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Telco Communication Systems is not liable for indirect, incidental, special or consequential losses, or for lost profits, lost revenue, lost data or business interruption, arising from your use of this site. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Our liability for work we carry out is governed by the agreement covering that work.
Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your misuse of the site or your breach of these terms.
Governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. The state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction over any dispute arising from them.
Changes
We may update these terms. The date at the top shows the current version, and continuing to use the site after a change means you accept it.
